Terms of Service

Last updated 15 October 2026

These terms govern your use of GitHub Backup Observatory (“the service”), operated by Shardendu Mishra, an individual based in Hyderabad, Telangana, India (“we”, “us”). By creating an account or paying for a plan you accept them.

1. What the service is

  • The service has two parts: a backup agent that you run on a machine you control, and a hosted dashboard that schedules runs, shows their results and offers an AI assistant.
  • The agent clones your repositories and writes the archives to storage you choose and own: a git repository, a folder, or an S3-compatible bucket. The contents of your repositories never pass through our servers.
  • Our servers keep information about your runs, such as repository names, sizes, timings, results and error messages. The Privacy Policy lists what we keep and for how long.

2. Accounts

  • You sign in with GitHub. You must be 18 or older.
  • You are responsible for the machines you link to your account and the access tokens you create. Revoke an agent or a token in Settings as soon as you stop trusting it.

3. Plans, payment and the founding pre-order

  • Paid plans are paid a year in advance. The price and any taxes are shown before you pay. Payments are processed by Razorpay; we never see your card, UPI or bank details.
  • A founding pre-order is paid now for a service that starts at launch. Your first year starts on launch day, not on the day you pay. You can cancel a pre-order for a full refund at any time before launch, and if the service does not launch, every pre-order is refunded in full.
  • We do not currently sell to consumers resident in the European Union, the European Economic Area or the United Kingdom.
  • Refunds follow the Refund and Cancellation Policy; access after payment follows the Delivery Policy.

4. Your repositories and your storage

  • You keep every right to your repositories and to the archives. We claim no rights over them.
  • An archive is only as safe as the storage it lands in. Keep that storage’s credentials private and check from time to time that you can restore from it (a git bundle restores with git clone).
  • We do not promise that every run succeeds. The dashboard reports the result of each run; act on the ones that fail.

5. Optional research telemetry

The agent may offer research telemetry. It is off unless you turn it on in Settings, and you can turn it off at any time, which deletes what was collected. When it is on, the agent also reports, for every repository of each run, measurements of how it decides what to back up: decision reasons, when the repository was last pushed to, the time each step takes, byte counts, a size range and the outcome of storage checks. For about one repository in ten per run, it also reads the commits its branches and tags point to (without downloading anything else). Each repository is identified by a keyed hash, those commits are stored only as keyed hashes, and no name, path or repository content is ever included. We keep this data for one year, use it to improve the service and may publish aggregate results, for example in a research paper; no published result identifies you or a repository.

6. Acceptable use

Back up only repositories you have the right to copy. Do not use the service to break GitHub’s terms, to reach other people’s data or to overload our servers. We may suspend an account that does.

7. The AI assistant

The assistant answers questions over your backup history through a language model provider (OpenRouter), using the key you connect. Its answers can be wrong: check them before you act on them. Your questions and its answers are stored with your account.

8. Availability and changes

We run the service on a best-effort basis, without a guaranteed uptime. Features may change; we tell paying users by email before we remove a feature they paid for.

9. Liability

To the extent the law allows, the service is provided as it is. We are not liable for indirect or consequential losses, or for data lost from storage that you own. Our total liability for any claim is limited to what you paid us in the 12 months before the claim.

10. Ending the service

You can close your account at any time by writing to [REAL DATA REQUIRED: support email]. We may close an account that breaks these terms. If we end a paid plan without such a reason, we refund the unused part of it.

11. Trademarks

GitHub is a trademark of GitHub, Inc. This service is not affiliated with or endorsed by GitHub.

12. Governing law

These terms are governed by the laws of India. The courts of Hyderabad, Telangana, India have jurisdiction over any dispute about them.

13. Changes to these terms

We post every change on this page. For a change that affects paying users materially, we also email them at least 14 days before it applies. Questions about these terms: [REAL DATA REQUIRED: support email].
